A Park City family is fighting to keep its tree house after the city says it doesn't belong.

Kathy Damon says her three kids are very disappointed because the city planning commission is telling them to take down their tree house, saying it doesn't fit zoning rules. Damon recently appealed and lost.

She said, "We don't agree that it should be defined as a structure. It's a tree house, it's a children's toy."

She says this started when someone complained to their home owners' association about the tree house. The association, in turn, went to the city.

Damon doesn't even know who made the complaints and says almost all her neighbors have come by to say they like the tree house, one neighbor even wanted to spend a night in it.
