SALT LAKE CITY (AP) -- Attorneys for death row inmate Douglas Carter are expected to ask a Provo judge to allow him a second appeal of his murder conviction.
The motion being heard Friday afternoon is Carter's second petition for post-conviction relief in 4th District Court. A ruling in the federal appeals process returned the case to the state courts to settle unresolved claims.
A jury convicted Carter in 1985 in the death of Eva Olesen, 57, during a robbery at her Provo home. Olesen was stabbed 10 times and shot in the head.
The conviction was upheld on an initial appeal in 1989.
Carter's current attorneys say he previously had inadequate counsel and should get another hearing.
State attorneys says Carter's motion should be denied because it was filed eight years too late.
