OGDEN — Criminal charges filed Monday against two Weber County residents shed new light on a fatal shooting that left one man dead in October.

Timothy Ryan Robinson, 43, of Ogden, and Nickie Kay Holder, 41, of Washington Terrace, are charged in connection with an Oct. 2 shooting at Bramblewood Apartments in Ogden. The shooting resulted in the death of 30-year-old Jonathan Brewer.

Robinson faces two counts of obstructing justice, a second-degree felony, and Holder is charged with conspiring to commit aggravated assault, a third-degree felony.

Now four people who have been charged in connection with the shooting. Dustin Smith and Barry Bingham both face two counts of obstructing justice, a second-degree felony. Smith also faces a charge of possession of a firearm by a restricted person, a second-degree felony.

Holder and Brewer are accused of trying to lure Smith into an apartment to assault him. After obtaining a warrant and searching Holder's phone, police say they believe Holder and Smith were in a past relationship that went bad. Holder allegedly sent messages to Brewer and another person "requesting that they seriously harm Smith," according to charging documents.

Police detail an alleged conversation between Holder and Brewer talking about Smith taking "the bait" and coming to the apartment. Messages allegedly show Brewer exited his vehicle at the apartment complex, with Holder turning around and asking Brewer to go back to his vehicle. Brewer ultimately went into the apartment, where a fight broke out between him and Smith, the charges state.

Smith ultimately shot Brewer during the fight, and Brewer died at the scene, according to police.

Charging documents in Smith's case allege he fled the apartment complex and drove north, and later threw the handgun used in the shooting out the window while driving onto I-15 near Ogden's 12th Street onramp. Smith drove the car to Box Elder County before abandoning it.

After leaving his car, Smith allegedly called Robinson to come get him. The two drove back to Ogden before they hid at a house for "several hours," according to charging documents. Police say Robinson requested Smith's Facebook password in order to delete Smith's account.

Robinson then allegedly took Smith to meet Bingham, who police say was pulling a trailer that belonged to Robinson. Bingham — who police say sprayed a cleaning liquid on the inside and outside of Smith's abandoned car — then drove Smith to southern Utah, and Smith lived in the trailer for several days, according to charging documents. Police also say Smith talked about the shooting to both Bingham and Robinson, who allegedly suggested that Smith flee to Mexico.

According to court records, summons were issued for both Robinson and Holder to appear in Ogden's 2nd District Court. As of Tuesday, Bingham remained in the custody of the Weber County Jail. Smith is in the custody of a state prison, as he was on parole at the time of his arrest.
