OGDEN — Two 18-year-olds have been charged in a gang-related shooting in Ogden over the weekend. One of the young men is facing a murder charge.

Devin Brock Smith was charged Monday in 2nd District Court with murder, a first-degree felony, in the shooting death of Miguel Angel Rios. Smith is also charged along with Jeremy Anthony Moncada with evidence tampering, a second-degree felony, and possession of a firearm by a restricted person, a third-degree felony.

Rios, 29, was shot multiple times in a home at 562 31st St. around 2:40 p.m. on May 6 and later died from his injuries at an area hospital. Police said Rios and Smith are members of rival gangs.

Witnesses reported two people had been seen running from the area after the shooting, according to police. Officers found Smith and Moncada in a nearby home, 3046 Porter Ave., and took them into custody.

As police served search warrants at the home, they located a .22-caliber revolver wrapped in an article of clothing and tucked into a crawl space, charging documents state. Smith told police he had been carrying the gun regularly for several weeks, including last week when he crossed paths with Rios.

"(Smith) said that (Rios) exchanged words and gang signs with him and 'flexed on him,'" which is when prosecutors say Smith shot Rios multiple times, according to court documents.

When they reached the house on Porter Avenue, Smith gave the gun to Moncada, who wrapped it in clothing and hid it in the crawl space, charges state. The two then changed out of the clothes they were wearing at the time of the shooting, according to the charges. They told police they had consumed a controlled substance on the day of the shooting.

Both Smith and Moncada have prior felony convictions and are prohibited from carrying a firearm, charges state.

Moncada is scheduled to appear in court Monday. Smith has a court date set for May 23.
