CORVALLIS, Ore. (AP) -- The $26.5 million lawsuit filed by the family of a missing Brigham Young University student against the company that employed her accused kidnapper and killer remains delayed because the company has filed for bankruptcy.

The 2006 lawsuit claims that Creative Building Maintenance, where Joel Courtney, worked when Brooke Wilberger disappeared in 2004, is liable because it hired the known sex offender without checking his background. The Brigham Young University student's body has not been found.

The company filed for bankruptcy after losing major accounts 11 days before the lawsuit was filed.

Benton County says it will seek the death penalty for Courtney.
