Provo School District May Use Eminent Domain to Buy Homes

Randall Jeppesen, KSL Newsradio The Provo School District Board of Education says they're willing to use eminent domain, if necessary, so they can rebuild a school.

Timpanogos Elementary School will be torn down and then rebuilt. For construction purposes the school wants to buy five adjacent homes, but two homeowners have rejected initial offers. The school board says they'll use eminent domain if they have to.

The school district's attorney Mark Robinson says negotiations look promising now that higher offers have been made. The homeowners weren't around when we stopped by to ask them how they felt, but the deadline for the school to start moving forward is fast approaching.

Mark Robinson, Provo School District Attorney: "I think that date is about 30 days away."

Under eminent domain the government has to pay the homeowners the fair market value, plus relocation expenses.
