VERNAL, Utah (AP) -- Attorneys for Vernal's only justice court judge want a charge against her dismissed, saying she committed no crime in refusing to allow police to talk with her adult son last year after he allegedly didn't pay for a taxi ride.
Cleopatra "Pat" McRae is on paid administrative leave and facing a misdemeanor charge of obstructing justice.
The charge stems from McRae allegedly interfering with police in December after they came to her Naples home to speak with her son -- who was visiting from Washington -- after he allegedly refused to pay a taxi driver.
The defense motion to dismiss says that when police came to the house, McRae said her son was sleeping and would speak to them the next morning.
A hearing on the motion is scheduled for May 29 before a 3rd District Court judge.
