OGDEN — A man charged in a “violent” gang shooting on April 27 was arrested by a U.S. Marshals task force Wednesday, authorities said.

Gilberto Noe Ruiz, 21, was arrested by the Violent Fugitive Apprehension Strike Team. He was charged in 2nd District Court on May 4 with attempted murder, a first-degree felony; obstructing justice, a second-degree felony; and possession of a dangerous weapon by a restricted person.

“We just had some information that he was in a little house on the east side of downtown,” said supervisory deputy U.S. Marshall Derryl Spencer, who is also the commander of the task force.

Police began searching for Ruiz after multiple witnesses of a drive-by shooting identified him as a participant, according to a police affidavit. The report stated a man was shot multiple times with a handgun near a home located at 887 30th Street.

Jose Damian Garcia, 25, was arrested on May 2 and also charged on May 4 in connection with the shooting.

The man who was shot suffered non-life threatening wounds in the shooting, police said.

The affidavit stated the shooting happened during a physical altercation and the victim told police he was shot as he tried to run from the scene. The man and a witness each identified Ruiz through a photo lineup as a man who drove a white SUV that fled the scene as a passenger fired shots, the affidavit stated.

It added that another witness also provided police a license plate number that came back to a white SUV registered to Ruiz.

One witness told police they saw both Garcia and Ruiz with handguns in their waistbands before the shooting. That witness said they “observed two separate individuals firing firearms towards the south, towards the victim,” according to the affidavit.

Garcia attempted to dispose of the gun through a cousin, who gave it to a friend. The friend called police the night of the shooting after receiving the gun, the report stated.

With the help of an informant, Garcia was identified on April 28 and arrested May 2 at a home on 2858 Adams Avenue, but he denied being a part of the altercation, the affidavit stated. Garcia's arrest happened more than three weeks before Ruiz was located.

Ruiz bailed out on $40,000 bond, according to jail documents. He is scheduled to make his initial appearance in 2nd District Court on Friday, according to court documents.
