PROVO, Utah (AP) -- A man with a history of filing disability lawsuits is suing a local market for not allowing him to use in-line skates.
Peter Jose Smith says Mercado Latino violated the Americans with Disabilities Act when it kicked him out for using his skates in the store. Smith says he skates behind a wheel chair because it's less painful than walking.
Hugo Martinez is the store's owner. He says Smith is trying to get rich with a frivolous lawsuit.
He says Smith was a frequent visitor to his store and had never worn skates inside it before 2006 when he kicked Smith out. Smith is seeking $1,000 in damages and access to the store.
A court date is set for August.
