(KSL News) Lawyers for Floyd Eugene Maestas want a new trial for their client.

Maestas was found guilty of capital murder for killing Donna Lou Bott three and a half years ago. Earlier this month, he was sentenced to die for his crime.

However, according to the Salt Lake Tribune, now his lawyers say Maestas should be granted a new sentencing trial due to possible juror misconduct. They claim that during the penalty phase, one of the jurors convinced the others that a sentence of life without the possibility of parole still made it possible for Maestas to get out of prison.

A judge in the case is now taking the issue under advisement.
