CLEARFIELD -- A Clinton man says he was illegally asked to leave a Clearfield restaurant because he had his service dog with him. Now investigators are reviewing whether the restaurant and the police acted appropriately.
Don Smith's dog, Junior, is registered as a service animal because it helps calm Smith when he suffers anxiety attacks. But Tuesday morning, the owner of the Star Café in Clearfield asked Smith and Junior to leave.
The restaurant's owner, Litung Liu, told the Standard-Examiner the Chihuahua/Jack Russell mix was running around, trying to play with other customers. He told Smith to leave.
Smith called police, saying the restaurant couldn't kick out a service animal under the Americans With Disabilities Act.
An officer arrived and also asked Smith to leave.
Smith claims the animal was always on a leash and stayed under a table while in the restaurant.
The police department is reviewing what happened to see if the officer acted appropriately.
