PROVO -- The man facing murder charges in the case of missing teenager Kiplyn Davis returned to court Wednesday morning. Timmy Brent Olsen is accused of killing her nearly 15 years ago.
The murder case has essentially been on hold for more than a year while appeals move through the Utah Supreme Court. Now, both sides have agreed to move the trial outside of Utah County, putting the case back on track.
"I appreciate that we're finally back to court and moving on, slowly, but at least we are doing something," said Richard Davis, Kiplyn's father.
Davis still gets emotional nearly 15 years after his 15-year-old daughter Kiplyn disappeared from Spanish Fork. For the past five years, the focus has been on three men who have all been convicted in federal court of perjury for lying to investigators about her disappearance.
Olsen is the only man charged with Kiplyn's murder. It's a case that remains mostly circumstantial.
Kiplyn's family is gearing up for this Sunday, which will mark the anniversary of her disappearance, on May 2, 1995.
"We're always hoping this is the year we can find Kiplyn and put her where she needs to be, and take this pressure off our family."
Davis believes the men all know something that could solve the case and finally give his family closure. But so far, none of them have cooperated with investigators.
There is no forensic evidence against Olsen, and Kiplyn's body has never been found.
Now that the judge is regaining jurisdiction of the case again, the next step will to be plan for a trial, which is likely still several months away.
