TACOMA, Wash. (AP) — A Washington state Court of Appeals has reinstated a child pornography charge against Steven Powell, and the Pierce County prosecutor says he plans to bring him to trial.

The prosecutor had appealed the decision to dismiss the charge during Powell's 2012 voyeurism trial for shooting photos and video of two young neighbor girls using the bathroom.

Pierce County Prosecutor Mark Lindquist told KOMO Powell can appeal to the state Supreme Court before the new trial could be scheduled.

The 64-year-old Powell was recently released from prison after serving 30 months for his voyeurism convictions.

He is the father of Josh Powell, who killed his two young sons and himself in February 2012 in Graham while under investigation for the disappearance of his wife Susan Powell in Utah.
