PRICE — A Magna man has been sentenced to serve one year in jail for a DUI crash that killed a Price woman in July 2013.

Alvin Clint Carter will also serve three years on probation, a judge ruled Monday. He faces up to five years in prison if he violates the terms of his probation, according to Carbon County Attorney Gene Strate.

Carter, 28, admitted in court records that he was under the influence of alcohol on July 7 when the pickup truck he was driving slid off Pondtown Road about 1:45 a.m., went down a 150-foot embankment and rolled multiple times.

Carter and Brooke Kristine Tomadakis, 22, were ejected from the truck. Another passenger, 30-year-old Chad Wink, of West Jordan, crawled out of the truck after it stopped rolling.

Tomadakis died at the scene. Wink, who suffered extensive injuries, was taken to a hospital by private vehicle.

A medical helicopter flew Carter to Utah Valley Regional Medical Center. A test performed on blood drawn more than three hours after the crash revealed that Carter's blood-alcohol content was 0.12, according to court records.

Carter pleaded guilty in January to one count of automobile homicide, a third-degree felony. On Monday, 7th District Judge Douglas Thomas ordered him to serve up to five years in prison, then suspended that sentence and imposed jail time and probation.

Thomas also ordered Carter to pay a $1,500 fine, complete community service and pay restitution. Carter also agreed to reimburse the Utah Crime Victim Reparations Fund for Tomadakis' funeral expenses, Strate said.
