Utah petitions for execution of death row inmate

SALT LAKE CITY (AP) -- The Utah attorney general's office has filed a 3rd District Court petition seeking an execution warrant for Ronnie Lee Gardner, one of 10 men on Utah's death row.

Gardner was sentenced to death for the Salt Lake City courthouse shooting of attorney Michael Burdell in 1985. Gardner was at the courthouse for a hearing related to a 1984 robbery and fatal shooting of another man.

Assistant Attorney General Thomas Brunker says that on Monday the U.S. Supreme Court rejected a request for a review of Gardner's case.

Brunker expects a state judge to hold a hearing on the petition in about 30 days.

If the execution warrant is signed, the Department of Corrections would set a date for the execution.

A telephone message left for Gardner's attorney was not immediately returned Thursday.
