LAYTON -- A woman is suing Layton City and one of its officers after she says she was touched sexually by the officer.
Police were called to a Layton home last July because of an argument among relatives. That's when Amanda De Los Rios, who is from out of state and was visiting family, was arrested for public intoxication.
De Los Rios says she had a few drinks at the home but denies being intoxicated. She says she was handcuffed behind her back and put in the front seat of a police car where an officer sexually abused her while on the way to jail.
"[It was] a bit of a struggle. He had to grab my legs several times very hard, and he had put his hand down the front of my pants," De Los Rios said.
She says she had bruises from the officer, which were documented in a rape report.
Her attorney, Robert Sykes, also says De Los Rios took and passed a polygraph test over the incident. He calls the act an unlawful seizure and intrusion that is prohibited by the Constitution.
The lawsuit doesn't specify the amount of damages being sought.
The Layton city attorney says the city did an extensive investigation and concluded the allegations were unfounded. He also says Rios recanted her story to them after making the report.
