SALT LAKE CITY (AP) -- A federal judge is expected to disclose the findings of a competency evaluation for the man charged in the 2002 abduction of Elizabeth Smart.
Brian David Mitchell was sent to the U.S. Medical Center for Federal Prisoners in Springfield, Mo., in December. He is not expected in court Friday, when the judge is scheduled to release his findings.
U.S. Attorney for Utah Brett Tolman sought the evaluation so he could begin prosecution of Mitchell in federal court.
Last March, a grand jury indicted Mitchell on charges of kidnapping and unlawful transportation of a minor.
Tolman believes Mitchell is competent and can stand trial. A state court found otherwise and declined to order forced medication.
