LOGAN — A Paradise, Cache County, man has been charged with assaulting a woman after threatening to get into a shootout with police officers.
Nicholas Codie Nelson, 23, is charged with three counts of aggravated assault resulting in serious bodily injury, a third-degree felony; plus carrying a dangerous weapon while under the influence of drugs/alcohol and property damage/destruction less than $500, class B misdemeanors; and disorderly conduct, an infraction.
Logan police were called June 14 to investigate a domestic dispute with Nelson and his girlfriend. Police say Nelson was "extremely intoxicated" and holding a gun, hitting a table and breaking items on the table. Nelson also threatened to kill his girlfriend and her family, a police booking affidavit states.
The girlfriend told police Nelson grabbed and pulled the back of her shirt, ripping off her necklace, and applied pressure to her neck with a fist. He also threatened to have a shootout with police officers if they showed up at the house, according to the affidavit. The girlfriend told police she called her mom, and Nelson grabbed the phone to prevent her from getting help.
One of the three counts of aggravated assault is related to a prior incident where Nelson's girlfriend was also the victim. She informed police June 14 that in April, Nelson put the muzzle of a gun against her face. She showed police pictures of an "imprinted ring just underneath her lip" left by the muzzle, the affidavit alleges.
When asked why he assaulted his girlfriend, Nelson allegedly told police he was "very upset" with her and that there was no good answer as to why he did it.
First District Judge Spencer Walsh denied bail for Nelson, saying there is "substantial evidence" showing he committed the assault and is likely still a danger to the woman. The victim scored highly on a lethality assessment, which evaluates how likely serious injuries or death are in cases of domestic violence, or how likely someone is to be killed by their partner.
Nelson is being held in the Cache County Jail.
