LOGAN — A Logan man is facing criminal charges after police say he raped a woman while she slept.

Jose Antonio Torres-Medina, 44, was charged Monday in 1st District Court with rape, a first-degree felony, and was ordered to be held without bail.

According to a police booking affidavit, a woman went to the Logan Police Department on Feb. 2 and told officers that on or around Nov. 11, 2022, she woke up and found signs that she'd been sexually assaulted. She also said she takes a medication that causes drowsiness and dizziness.

The woman told police she confronted Torres-Medina, who allegedly said they'd had sex and she'd enjoyed it. The woman said she asked Torres-Medina how she could have enjoyed it if she was unconscious, but he responded only that she liked it.

Police interviewed Torres-Medina at the Cache County Jail, where he was being held after his arrest for allegedly violating a protective order against the woman who made the rape report.

Torres-Medina told police that on the date in question, the woman wanted food at 4 a.m. He said she was getting drowsy and not driving properly on their way back from getting food, so they pulled over and he drove home. When they arrived, Torres-Medina said the woman wanted to have sex.

"He said the victim is convinced he is cheating on her and would have gotten mad at him if he did not have sex with her," the booking report states. "He said he was 'forced' to have sex with her because of this."

When asked what the woman was doing during sex, Torres-Medina said she was "just laying there" and was unable to fully dress herself afterward, the affidavit says.

"Jose has been arrested for a previous domestic violence offense against the victim and has already violated a protective order," it states.

Torres-Medina was arrested Feb. 9 after the woman said he did not return her dog, which was a stipulation of the protective order. He was charged on Feb. 10 with violating a protective order, a class A misdemeanor.
