Second man charged in connection with fatal shooting in Ogden

OGDEN — A second man was charged Monday in connection with a fatal shooting at the Bramblewood Apartments in Ogden last month.

Dustin Wayne Smith, 33, of Midvale, is charged in 2nd District Court with possession of a firearm by a restricted person and two counts of obstructing justice, both second-degree felonies.

About 12:15 a.m on Oct. 2, police were called to an apartment at 240 N. 180 East where a 30-year-old man was found deceased with a gunshot wound. The man's identity has still not been released as of Monday and he is only identified by the initials J.B. in court documents.

Smith went to the apartment to meet a woman and while at the apartment, the victim entered "and an altercation ensued. During the altercation, J.B. sustained a gunshot wound to the head and died from the injuries. Smith fled the scene," according to charging documents.

After his arrest, Smith claimed that he threw the firearm out the window of his vehicle near the 12th Street on-ramp to I-15 and then abandoned his car in Box Elder County, according to the charges. Both the gun and car were recovered by police.

Smith's charges come on the heels of charges being filed Oct. 26 against another man.

Barry Lenard Bingham, 41, of Bluffdale, was charged in 2nd District Court with two counts of obstructing justice, a second-degree felony. After Smith abandoned his car in Perry, Bingham sprayed the inside and outside of the vehicle with a liquid cleanser, possibly bleach, in an effort to destroy evidence, according to his charging documents.

Bingham is also accused of driving Smith to southern Utah after the shooting to help him avoid arrest, the charges state.

A witness told police that Smith was the gunman in the killing, according to court documents pertaining to Bingham. As of Monday, no charges have been filed related to the shooting death.
