SALT LAKE CITY — A federal judge removed himself Wednesday from Planned Parenthood of Utah's battle against the state.
U.S. District Judge Clark Waddoups gave no explanation in a one-sentence court filing for recusing himself and requesting the case be reassigned. Judge Dee Benson will now oversee the case.
Planned Parenthood is challenging the state's decision to cut off federal pass-through funds to the reproductive health organization.
Waddoups last year denied Planned Parenthood's request to stop the state from blocking the money while the lawsuit runs its course. The 10th Circuit Court of Appeals overturned the ruling and granted Planned Parenthood a preliminary injunction last month.
