OGDEN, Utah (AP) -- A 2nd District judge is ordering a man charged with murder to spend another 90 days in the state mental hospital because he's not competent to stand trial.
Merlynn Kilfoyle is charged in the May 2000 death of John Thomas Rush. Rush was found dead in an Ogden home with a gunshot wound in the head.
Kilfoyle was initially found competent to stand trial early last year, but his defense attorney Kilfoyle's time in jail has taken a toll on him. He declined to provide specifics.
In October, a judge found Kilfoyle incompetent. A review is set for June 19.
