PROVO, Utah (AP) -- Nathan Herbert, a son of Lt. Gov. Gary Herbert, is to stand trial Thursday on a misdemeanor charge that he assaulted a Utah County woman.
The woman also has a stalking injunction against him.
The assault charge stems from an incident in July 2005 when the woman claims Herbert blocked her with his car while she and a friend were driving around Brigham Young University.
She said he got out of his car, and, "the next thing I (knew), I felt both of his hands around my neck and he was shaking me."
The simple assault charge is a Class B misdemeanor and carries a maximum sentence of six months in jail and a $1,000 fine.
Calls to Herbert's attorney were not returned Thursday.
Herbert's bench trial is in front of 4th District Judge Steven Hansen.
