(Salt Lake City-AP) -- Elizabeth Smart's accused kidnapper is expected to face a judge today for retail theft charges.

Brian Mitchell is facing charges for stealing items from a downtown grocery store.

The 49-year old pleaded innocent to the misdemeanor retail theft charge on March 14.

The charge is not related to the kidnapping charges Mitchell and his wife face in the abduction of Elizabeth Smart from her bedroom last summer.

Mitchell is undergoing mental competency evaluations and it's unclear whether they are finished and if he'll be in court today.

However, no case can proceed while competency is being examined.

Mitchell and his wife Wanda Barzee are being held on $10 (m) million dollars bond.
