(KSL News) A 21-year-old man charged with fatally shooting his father in 2004 is competent to stand trial.

Benjamin Gully is charged with first-degree murder for shooting his father, James Gully, while they were duck hunting at Farmington Bay.

In October 2005, Gully's attorney and prosecutors agreed he was not competent to stand trial at that time.

He has since received treatment for an undisclosed mental problem and is now competent for trial.

The Deseret Morning News reports doctors are now evaluating Gully to determine if he was incompetent at the time of the alleged crime.
