PROVO — Criminal charges were filed Monday against six men accused of committing a violent attack in Eagle Mountain where multiple shots were fired into a family's home.
David Lopez, 18, Hector Lopez-Tamayo, 21, Cesar Martin Barragan, 19, and Landon Perez-Arroyo, 18, all of Orem; Irwin Perez-Berrera, 18, of Provo; and Sebastian Osore-Guillen, 18, whose hometown is listed as unknown, are each charged in 4th District Court with three counts of aggravated assault, two counts of discharge of a firearm, and criminal mischief, all second-degree felonies.
All the charges are subject to gang enhancement penalties if convicted, according to court documents.
About 3:30 a.m. on Dec. 6, seven people walked into the backyard of an Eagle Mountain residence and onto the family's deck.
Hector Lopez-Tamayo broke the glass door with a rifle he was holding and fired six rounds into the house, according to charging documents. Barragan is charged with using a baseball bat to smash windows and other glass parts of the house while others threw rocks at the windows.
The group then went to the front of the house where David Lopez fired five rounds into a minivan parked in the driveway, the charges state.
The group's actions were recorded by home security cameras, according to police. A couple and their 12-year-old son were in the home at the time of the shooting. No serious injuries were reported.
"The victims believed this incident was in retaliation involving their 16-year-old son," according to the charges.
Police say the son is a suspect in an assault investigation. On Nov., 25, the family's 16-year-old son rammed into a vehicle being driven by Lopez that belonged to his brother, Lopez-Tamayo, the court documents say.
After the incident, police began rounding up suspects over the course of several days. A juvenile was also arrested in connection with the incident. It was unknown Monday whether the juvenile had been formally charged. Investigators say the are still in the process of identifying others involved.
A rifle and three handguns were recovered by police as part of their investigation.
Prosecutors have asked that Lopez, Lopez-Tamayo and Barragon be held without bail.
