(KSL News) The gun shop where Sulejman Talovic purchased a shotgun used in the Trolley Square shooting is asking the judge to dismiss a lawsuit filed against them.
Sportsman's Fast Cash and Westley Hill claim Talovic's actions could not have been predicted, but a lawsuit filed by one of the survivors, Stacy Hanson, argues the shooting would have never happened if Hill hadn't sold Talovic the shotgun.
Talovic killed five people and injured four at Salt Lake City's Trolley Square mall in February 2007. He died in a shootout with police.
Hill has pleaded guilty to a federal misdemeanor for failing to record Talovic as a resident alien.
He received one year of probation and a $500 fine.
