PROVO — A Spanish Fork woman accused of trying to have her ex-husband killed to get custody of their children and money from his life insurance policy pleaded no contest to the charges Thursday.

Billie Jo Agee, 46, pleaded no contest to one count of criminal solicitation, a third-degree felony. She originally faced two counts of criminal solicitation to commit murder, a first-degree felony.

In February, Agee "solicited her second estranged husband to kill her first ex-husband so she could get access to her children and obtain the proceeds of his $1 million life insurance policy," according to court documents.

At the time charges were filed, Spanish Fork Police Lt. Matt Johnson said no money changed hands and no discussion took place about how the ex-husband should be killed, but Agee made it clear she wanted him "out of the way."

"She did not state how she wanted it to happen. She just made requests … two to three times," Johnson said.

Agee's criminal history in Utah includes a guilty plea to DUI in May 2016, according to court records. A child support lien case was filed against her on March 8 by the Utah Office of Recovery Services, court records show.

Sentencing in the case is set for July 13. The third-degree felony carries a potential maximum sentence of up to five years in prison.

Agee remains in custody in the Utah County Jail.
