SALT LAKE CITY — A federal appeals court will hear arguments in Planned Parenthood of Utah's appeal of a judge's order allowing the state to divert funds from the organization.
The 10th Circuit Court of Appeals on Tuesday scheduled a March 8 hearing in Denver. The court also set an expedited schedule for the parties to submit written arguments.
Federal pass-through funding for Planned Parenthood was set to expire Dec. 31 after U.S. District Judge Clark Waddoups denied its request for an injunction. Planned Parenthood appealed to the 10th Circuit and won an emergency request to put Waddoups' decision on hold.
In August, Gov. Gary Herbert directed the state health department to withhold about $230,000 intended for the organization, leading Utah Planned Parenthood to sue the state.
Herbert's order came after the release of several secretly recorded videos purporting to show Planned Parenthood officials bargaining over the price of aborted fetal tissue. Planned Parenthood officials have called the videos highly edited and misleading.
