Judge won't dismiss negligent homicide charge

SALT LAKE CITY (AP) -- A 3rd District Court judge won't dismiss a negligent homicide charge against a Taylorsville police officer accused of killing a motorist while chasing a stolen car.

Joseph Corbett is charged in the death of motorist John Terry Douglas.

At the time of the crash, Corbett was attempting to assist another Taylorsville officer in a chase.

Defense attorney Ed Brass says the charge is unconstitutional because lawmakers told the Department of Public Safety to come up with rules for police chases.

But Judge Robert Adkins wrote that even though DPS never defined any rules, state law requires emergency vehicles to activate lights and siren when exceeding the speed limit and slow down as needed when running red lights and stop signs.
