TERRE HAUTE, Ind. (AP) — A judge has sentenced an Indiana man tried three times for a 1979 slaying to 100 years in prison after DNA on the victim's shirt linked him to the killing.
Fifty-eight-year-old Richard Boswell Jr. was sentenced Monday for the murder of 19-year-old Kathy Jo Baker of Riley and the attempted murder of her then-2-year-old son.
A Vigo County jury convicted the Terre Haute man in April during his third trial. Two trials in 2013 ended in mistrials.
The Tribune-Star reports (http://bit.ly/1Puom19 ) that defense attorney Michael Wright argued that Boswell should serve the sentences at the same time instead of consecutively because the crimes occurred at the same time.
Boswell's DNA was in a state database when a 2008 test on blood found on Baker's shirt linked him to the crimes.
