SALT LAKE CITY (AP) -- An attorney for Jennete Killpack has asked the Utah Supreme Court to overturn her one-to-15 prison term for the death of her 4-year-old adopted daughter.
Cassandra Killpack died in 2002 after being forced to drink more than 2.5 liters of water as a punishment for taking her sister's juice.
A jury convicted Jennete Killpack of child abuse homicide in 2005.
On Tuesday attorney Mike Esplin told justices that Jennete Killpack was only following the advice of professionals when she poured water down her daughter's throat in an attempt to correct behavioral problems.
Prosecutors, however, said Killpack was an abusive mother with a pattern of abuse that included choking and "back-handing" the little girl.
