OGDEN, Utah (AP) -- A judge has thrown out a request to have Ogden Mayor Matthew Godfrey removed from the November ballot.
Second District Judge Parley Baldwin dismissed a lawsuit that alleged a technical campaign violation.
The lawsuit claimed Godfrey illegally left out his campaign committee in election filings. But the city ordinance allows a candidate to either name himself as the committee or list a committee. Baldwin found the case without merit and tossed it out.
The judge is also considering having the plaintiffs pay the defendants' legal fees.
