Hershey settles lawsuit with Simon & Schuster over book's dust jacket

A federal lawsuit has been settled by confectionery manufacturer Hershey Co over a picture of a chocolate Hershey's Kiss on the cover of a new book to be published by Simon & Schuster Inc about the company's founder by Michael D'Antonio entitled Hershey: Milton S. Hershey's Extraordinary Life of Wealth, Empire and Utopian Dreams, which is scheduled to launch in January. According to The Associated Press, under the terms of the settlement the publisher has agreed to add an image in the upper left corner of the dust jacket's front cover stating that the book is "neither authorised nor sponsored by The Hershey Company."

Although Hershey reportedly did not object to the book's content it was concerned that the image used on the dust jacket may imply that the company endorsed the book. In addition a disclaimer has also been placed on the websites of online retailers of the book.
