PROVO, Utah (AP) -- The Utah Supreme Court has overturned a lower court's dismissal of a case involving the death of Eagle Forum President Gayle Ruzicka's son on grounds that the defendant didn't understand his Miranda rights.
The Daily Herald of Provo reports the high court's decision issued Friday returns defendant Gareth Bozung's case to 4th District Court for further proceedings.
Bozung was charged with possession and distribution of illegal drugs in Ruzicka's 2007 death from a fatal drug overdose.
Fourth District Judge Claudia Laycock determined that Bozung had not understood his right to remain silent when questioned by investigators about the death.
But prosecutors argued that Bozung had understood his Miranda rights.
