Court Dismisses Lawsuit by Utahn Who Found Tooth in Soup

SALT LAKE CITY (AP) -- The Utah Court of Appeals has upheld the dismissal of a lawsuit brought by a Utah woman who claimed her 13-month-old son found a human tooth in a can of Campbell's soup.

The 2003 lawsuit by Tina Keeney was dismissed by a judge, who said Keeney failed to show she suffered bodily harm or illness from the discovery.

Keeney claimed she suffered emotional distress after allegedly finding the tooth, which her attorney said a pathologist confirmed was a human molar. She also claimed she lost weight and developed a "hyper-vigilance" toward prepared food.

The appeals court acknowledged Keeney's experience may have been disturbing, but said her reactions were within a reasonable person's ability to cope. The court also said she never sought medical help or provided expert testimony that her anxiety was a symptom of mental illness.
