FARMINGTON, Utah (AP) -- A murder trial for a Davis County man accused of stabbing a woman with a steak knife 51 times has been delayed pending an evaluation of his mental health.
Prosecutors charged Phillip Joseph Simmons with murder nearly three years ago. He is accused of fatally stabbing Suzanne Fry in her Bountiful apartment on Jan. 20, 2008. The 38-year-old could spend the rest of his life in prison if he's convicted.
Simmons was previously deemed incompetent for trial and was treated at the state mental hospital. A judge has since ruled Simmons competent, but an evaluation was ordered to determine whether he was incompetent at the time of the alleged crime.
An evaluation was scheduled for this week, but wasn't completed. That forced a delay of the trial, the Standard Examiner of Ogden reported.
