SPANISH FORK -- A Spanish Fork man has been charged with manslaughter in the death of one of his best friends. His friend died from a gunshot wound while playing Russian roulette during a night of drinking.
Police say there is no question that the gunshot wound to the head was self-inflicted. Prosecutors say the man's friend, however, created an atmosphere of recklessness, which led to the tragic death.
Police say several people were drinking on April 21 at a home near 500 North and 920 East in Spanish Fork.
Merrill Chet McKell, 41, who faces the manslaughter charges, called police to report his friend, 27-year-old Cody Hales, had been shot in the head. Hales was rushed to the hospital but didn't survive.
Spanish Fork police investigated and determined that McKell had suggested they play Russian roulette. McKell allegedly then loaded one round into chamber of a .22-caliber revolver. Hales picked up the gun, pointed it at his head and pulled the trigger.
Prosecutors say the criminal charges were filed after much discussion in the county attorney's office.
Deputy Utah County Attorney David Sturgill said, "We in no way believe this was done intentionally and knowingly or with any malice. It's truly a tragedy. But the act was reckless and, because we concluded that the recklessness caused the victim's death, the manslaughter charge fit."
McKell made his first appearance in court Wednesday morning, as the charges against him were read. He was appointed a public defender to represent him. The manslaughter charge could mean up to 15 years in prison, if he is convicted. Prosecutors acknowledge McKell is already dealing with the emotional toll of being involved in his friend's death.
McKell is due in court Aug. 4.
