Bank of America can make foreclosure sales in Utah

SALT LAKE CITY (AP) -- A federal judge has overturned a state court order and will allow Bank of America to sell hundreds of foreclosed homes in Utah.

U.S. District Judge Craig Waddoups on Friday overturned the order that stopped Charlotte, N.C.-based Bank of America last month from selling the foreclosed homes.

An attorney for a St. George homeowner persuaded 5th District Judge James Shumate to stop the sales because the Bank of America isn't registered to do business in Utah.

The Bank of America says it's federally chartered and doesn't have to register in Utah, something confirmed to The Associated Press by state regulators.
