SALT LAKE CITY -- A judge has set a trial date for former Utah Senate Majority Leader Sheldon Killpack, who is challenging the suspension of his driver's license after his arrest for drunk driving.
A trooper pulled him over for driving erratically on Jan. 15 near 700 East and 3300 South. Killpack lost his license after he refused to take a breathalyzer test.
His attorneys claim Utah Highway Patrol troopers did not have reasonable grounds to request the test. UHP says Killpack "performed poorly" during field sobriety tests. Prosecutors say Killpack had a blood-alcohol level of 0.11.
Killpack will appear at a bench trial over the suspension on May 25.
Killpack resigned from the Legislature the day after the arrest. He has since pleaded not guilty to DUI charges.
