(Salt Lake City-AP) -- Elizabeth Smart's accused kidnapper won't be facing a judge today after all.
Brian Mitchell was expected to face a judge today for retail theft charges.
The 49-year old pleaded innocent to the misdemeanor retail theft charge on March 14.
Mitchell's accused of stealing items from a downtown Albertson's grocery store.
The charge is not related to the kidnapping charges Mitchell and his wife face in the abduction of Elizabeth Smart from her bedroom last summer.
Mitchell is undergoing mental competency evaluations and the case can not proceed while competency is being examined.
The court hearing has not yet been rescheduled.
Mitchell and his wife Wanda Barzee are being held on $10 (m) million dollars bond.
