BOZEMAN, Montana (AP) — The trial for a man accused of fatally shooting one man and wounding another after a Bozeman house party in September 2013 has begun. Both sides agree over who fired the shots, but they differ over why the shots were fired.
The Bozeman Daily Chronicle reports (http://bit.ly/1JZCBra ) 26-year-old Cody Little is accused of shooting and killing 24-year-old Larry Clayton and injuring James Armstrong. Little faces charges of deliberate homicide, aggravated assault and assault with a weapon.
During opening arguments Thursday, defense attorney Chris Petaja said Little shot the men because post-traumatic stress disorder from military service affected his thinking and he went into "combat mode" in response to a perceived threat.
Gallatin County Attorney Marty Lambert argued Little had been the aggressor that morning and was intent on hurting the victims.
Little's trial continues Friday.
