Eugene Delgado, 38, was shot in the stomach last night after fighting with three Salt Lake County deputies. He's now in critical condition.

It's not the first time they've been called to the home at 4171 W. 5985 South in Kearns for domestic violence, so an extra officer responded to the call.

A sheriff's spokesman says deputies first used pepper spray, which didn't work, then collapsible batons.

Deputies say the suspect grabbed a baton from a female deputy and attacked her. She shot him.

Eugene Delgado's older brother says Eugene is mentally disabled and probably off his medication, but still thinks deputies shouldn't have used potentially deadly force.

"If they're trying to protect Mom, why didn't they take him out six months ago? We tried to have him committed. I had a feeling a year ago that he was going to kill somebody in the house," Eugene's brother says.

His 65-year-old mother is expected to be okay. And although Delgado's in critical condition, he is expected to recover.

The suspect has been in trouble with police before for forged prescriptions and retail theft.
