(Provo-AP) -- Richard and Jennete Killpack are accused of killing their adopted daughter by forcing her to guzzle water. Now a judge is giving them two weeks to contest prosecutors' plan to elevate the charges to first degree murder.

They'd originally been charged with second-degree child abuse homicide.

The defendants stood silently while their attorneys got the news. The defense lawyers asked what new evidence the state has found.

The judge has issued a gag order in the case -- so the attorneys aren't talking outside of court, and prosecutors have refused to say why they filed the elevated charges.
