SALT LAKE CITY -- A federal judge has ordered I-B-M to turn over more programming code to S-C-O Group in the two companies' long battle over the Linux operating system.
S-C-O's lawsuit accuses I-B-M of illegally inserting proprietary Unix code into Linux. The Lindon, Utah-based S-C-O is seeking at least five (B)billion dollars from I-B-M.
The ruling was released late yesterday, and it orders I-B-M to produce the additional code by March 18th.
Wednesday's ruling comes after S-C-O had claimed that I-B-M had not turned over enough relevant material in the case, including code and programmers' notes.
I-B-M said it has met S-C-O's requests, and that expanding the lawsuit's discovery process amounts to a fishing expedition.
Shares of S-C-O soared nearly 20 percent today on the Nasdaq exchange.
