SALT LAKE CITY (AP) -- Another evaluation has been ordered for De-Kieu Duy, who has yet to be found competent to stand trial for murder in a shooting rampage at the Triad Center in January 1999.
After a meeting 3rd District Judge Judith Atherton, defense attorney Karen Stam said Wednesday that the judge had ordered one last evaluation from the Utah State Hospital, which is due in August.
If Duy, 30, remains incompetent to stand trial, prosecutors will initiate civil commitment proceedings by Aug. 30, Stam said.
According to the charges, on Jan. 14, 1999, Duy entered the lobby of the Triad Center with a 9mm handgun and began shooting after she demanded to see a KSL television reporter and was refused entry to their offices.
Two bullets grazed a building manager, and AT&T employee Anne Sleater was fatally shot in the head before a co-worker of the victim wrestled the weapon away.
Duy was charged with capital murder, attempted aggravated murder and aggravated assault.
If Duy is committed, her doctors would be required to report to the court if she ever became competent and she would still face the charges.
