SALT LAKE CITY (AP) -- The widow of a man wrongly suspected in the kidnapping of Elizabeth Smart is appealing a wrongful death lawsuit.
Last week, a federal judge tossed out Angela Ricci's lawsuit against the Salt Lake City Police Department over the treatment of her husband, Richard Ricci.
This week, Ricci's attorneys filed a notice of appeal to the Tenth U-S Circuit Court of Appeals in Denver.
Richard Ricci suffered a fatal brain hemorrhage while being held in prison in 2002.
The judge ruled that plaintiff had failed to provide evidence implicating the city in the treatment Ricci received in prison.
Angela Ricci said her husband lost his life in prison because the Salt Lake City police decided he was guilty based on no evidence whatsoever.
