OGDEN, Utah (AP) -- A new trial has been set for an Ogden man accused of kidnapping and threatening to kill his estranged girlfriend nearly six years ago.
A retrial is set for Feb. 12-16 for Robert Brian Pedockie for the Jan. 2, 2001, incident where he was accused of abducting an estranged girlfriend at gunpoint.
Pedockie, 37, had exhausted seven attorneys and numerous appeals in his case when the Utah Supreme Court ruled in June he should have a new trial.
Among the issues the court found merited a new trial were those related to Pedockie serving as his own attorney.
Pedockie once sought to dismiss the charges against him claiming he was denied his rights to a speedy trial, despite the fact it was his continual firing of his lawyers that delayed the proceedings.
He's fired four public defenders and two private attorneys withdrew from his case, one after representing Pedockie for only three weeks, according to court records. He was found guilty by a jury deliberating 95 minutes after four days of testimony.
In February 2003, Pedockie was sentenced by Judge Ernie Jones to 10 years to life in prison on the first-degree felony charge of aggravated kidnapping.
At a pretrial hearing last month, Jones denied Pedockie's motion to fire his current public defender.
