PROVO, Utah (AP) -- A Provo man has pleaded guilty to criminal homicide in the death of his infant daughter.

Victor Gardea entered the plea in 4th District Court on Thursday. The 23-year-old had been charged with aggravated murder in the September death of his 4-month-old daughter, Jasmin.

The charges are both first-degree felonies, but the one Gardea pleaded to carries a lesser possible sentence than the original charge.

On Sept. 8, officers were called to a Provo home and found the girl not breathing and with no pulse. She died the next day.

Prosecutors say Gardea was caring for Jasmin and became frustrated with her crying because he was afraid it would wake his son. They say he then hit her at least once in the head and torso.
