SALT LAKE CITY (AP) -- The man charged with kidnapping Elizabeth Smart is scheduled for a competency hearing this week.
Brian David Mitchell is due for a one-year review hearing Monday before 3rd District Judge Judith Atherton. The self-proclaimed prophet who has been kicked out of court numerous times for his outbursts and Biblical rants was found incompetent to stand trial a year ago.
Doctors from the Utah State Hospital filed an update on Mitchell's mental status with the court earlier this month. The results could be made public Monday.
Doctors at the state hospital in Provo have been trying to rehabilitate Mitchell without drugs.
His estranged wife, Wanda Barzee, was also charged with kidnapping Smart at knife-point from her home in June 2002. The couple and the teen were found walking on a suburban street nine months later.
Atherton ruled in June that Barzee could be forced to take anti-psychotic drugs, but the decision was appealed. Barzee has refused to take the anti-psychotic medication because she does not believe she is mentally ill.
Mitchell and Barzee were indicted by a state grand jury on charges of aggravated kidnapping, two counts of aggravated sexual assault, two counts of aggravated burglary and conspiracy to commit aggravated kidnapping.
